TRAI to finalise views on regulation of OTT services by May 2019

Telecom Regulatory Authority of India (TRAI) hopes to finalise its views on over-the-top (OTT) services by end May 2019. The bone of contention is whether OTT services should be brought under the regulatory regime. The regulator will keep global best practices in mind and is studying the European Electronic Communications Code for the same.

TRAI has clarified that the scope of its consultation would be regulatory issues and economic concerns regarding those OTT services that are either same or similar to those being provided by telcos. OTT services refer to applications and services that are accessible over the internet over a telco’s network.

TRAI is conducting an open house discussion on OTT issues in Bengaluru on April 24, 2019 and plans to conduct a similar exercise in Delhi soon.

In 2018, TRAI had issued its consultation paper – ‘Regulatory Framework for Over-The-Top Communications Services’ - to discuss whether OTT players should be brought under the regulatory regime. The paper is aimed at analysing and discussing required changes in the existing regime to govern OTT entities and the manner in which they should be implemented.
